What Is the FMCSA Clearinghouse?
The Clearinghouse is a secure, online database maintained by the Federal Motor Carrier Safety Administration (FMCSA). It is designed to track drug and alcohol program violations by Commercial Driver’s License (CDL) holders across all FMCSA-regulated employers.
The purpose of the Clearinghouse is to increase safety and transparency in the trucking and transportation industry by preventing CDL drivers from hiding violations when applying for new jobs. All FMCSA employers are required to use the Clearinghouse to review a driver’s record before hiring and at least once annually thereafter.
If a violation is found (e.g., a positive drug or alcohol test). In that case, the Clearinghouse also tracks whether the driver has completed the Return-to-Duty (RTD) process under the supervision of a qualified Substance Abuse Professional (SAP). This ensures that only eligible and safe drivers are permitted to return to the road.
Understanding Queries in the Clearinghouse
A query is essentially a background check that employers run through the Clearinghouse to determine whether a CDL driver has any past drug or alcohol violations or if they are in the RTD process.
There are three types of queries FMCSA employers must understand and comply with:
1. Pre-Employment Query
- Mandatory before hiring a CDL driver.
- Required by 49 CFR Part 382.
- Ensures no past violations are hidden during the hiring process.
2. Limited Query
- Required annually for all currently employed CDL drivers.
- Confirms that no violations have been reported over the past year.
- If no violations are found, the check ends here.
3. Full Query
- Triggered only if a Limited Query returns a “Record Found”.
- Provides detailed information on the specific violation(s).
- The employer must obtain the driver’s consent before conducting a full query.
