Is a driving school responsible for its students’ compliance with testing regulations?

Not always.
If the driving school is not acting as an employer, the student driver is ultimately responsible for complying with DOT drug and alcohol testing regulations (49 CFR Part 382).

However, the school may choose to verify that the student has met all compliance requirements before allowing them to operate a CDL vehicle. This is a best practice to ensure safety and regulatory adherence, even if not legally required.

If the school does employ the student driver, then the school would be considered an employer and must comply with all applicable DOT testing requirements.
