Reporting a violation(Employer)
What violations does the employer need to report?
Employers only have 3 business days to report a violation. Employers need to report any refusal to test ( drug and alcohol), for example:
- The donor leaving the collection site before completion,
- Not providing a sufficient sample without a valid medical explanation,
- failing to remove their jacket or empty their pockets,
Employers must also report if the donor fails to report to scheduled testing, especially random or post-accident. If the breath alcohol test is greater than 0.04, the employer will need to report that as well.
Employers also need to report any drug or alcohol use on duty (also for alcohol use within 4hours before duty). Employers also need to report negative return to duty results; the MRO will only report the initial positive result. Anything following the Return to Duty process, the employer will need to upload to the clearinghouse unless they are using a C/TPA.

Step 1: Log in to the Clearinghouse
- Go to the official Clearinghouse website
- Click “Log In” using your Login.gov credentials associated with your employer account.
Step 2: Navigate to the Violations Section
- Once logged in, go to your Dashboard.
- Under the “Violations” section, click “Report a Violation.”
Step 3: Enter Driver Information
- Provide the driver’s:
- CDL Number
- Issuing State
- CDL Number
- This ensures the violation is correctly linked to their Clearinghouse record.
Step 4: Select the Type of Violation
- Choose whether the violation is drug or alcohol related.
- From the dropdown, select the specific violation type, such as:
- Refusal to test
- Actual knowledge of use
- BAC ≥ 0.04
- Return-to-Duty negative result
- Completion of follow-up testing plan
- Refusal to test
Step 5: Enter Violation Details
- Fill in the required fields, including:
- Date of violation
- Description of what occurred
- Supporting documentation (upload any relevant files like test results, signed refusal forms, witness statements, etc.)
- Date of violation
Step 6: Review and Submit
- Double-check that all the information is accurate and complete.
- Click “Submit” to upload the violation to the driver’s Clearinghouse record.
Once submitted, the violation becomes part of the driver’s official DOT record.
