When is a truck driving school required to conduct DOT-regulated testing?

A truck driving school is required to comply with DOT drug and alcohol testing regulations under 49 CFR Part 382 when:

  • The student driver is employed by the school, or
  • The school leases a Commercial Motor Vehicle (CMV) to the student, and that CMV is operated in commerce.

In either case, the school is considered an employer under DOT regulations and must follow all applicable testing requirements, including pre-employment, random, post-accident, and reasonable suspicion testing.
