Are students training to be commercial motor vehicle drivers subject to drug and alcohol testing?

Yes—if they are operating a CMV in commerce with a CDL or CLP.

According to 49 CFR Part 382, student drivers are subject to DOT drug and alcohol testing requirements if they:

  • Are operating a Commercial Motor Vehicle (CMV) in commerce, and
  • Hold a valid Commercial Driver’s License (CDL) or Commercial Learner’s Permit (CLP).

In this case, the student is treated like any other safety-sensitive driver under DOT regulations and must comply with pre-employment, random, post-accident, reasonable suspicion, and other required testing protocols.

If the student does not have a CDL or CLP, DOT testing rules do not apply.
